Custodial torture in Karimganj, OC allegedly rubbed chili power in private parts of accused; Case registered against Police Officer

Nilambazar Police arrested two accused for allegedly stealing silver jewelery and mobile phones from the locality. As per the court order, the duo were limping on their way to the court. When they were asked about the detoriation in the condition of their health, they said they were mercilessly tortured by the OC Of Nilambazar Police Station, Dipjyoti Malakar.

“It may be stated here that at the time of their production before the court on 13.10.2022, the aforesaid accused (Hussain Ahmed alias Raju Ahmed and Munaf Miya) persons were found limping and on being asked, the accused persons stated that they were taken to Nilambazar P,S on the last night and then the O/C, Nilambazar P,S had beaten them mercilessly by stick and also rubbed petrol and chilies on their whole body, including on their private parts. Since the allegation was of custodial torture, so the oral allegations of the accused persons were reduced into writing and then their staterents were recorded on oath.”

According to the lawyer, the judge asked onduty police personnel about the instance. “The Police personnel clearly stated that the OC had asked him to get chili powder and all.” However, OC Malakar denied all alegations against him.

The court order added, “The aforesaid statement (reduced into writing) of accused Hussain Ahmed @ Raju Ahmed be registered as a complaint case against the O.C, Nilambazar P.S namely Deepjyoti Malakar under section 323/330 IPC in which the accused Hussain Ahmed would be the compainant.”

“A true copy of this order along with the true copy of order dated 13,10, 2022, photocopy of medical examination reports of the accused persons of this case, statement of other accused Manaf Miya and other witnesses in original be made part of the proposed complaint case,” added the order.

It concluded, “In-charge G.R branch is to put up the C/R on 26.10.2022 for considering the reference of the allegation to the honourable Gauhati High Court for initiating Contempt of Courts Act. proceedings against OC Nilambazaar PS Sri Deepjyoti Malakar under section 2 (B) of the Contempt of Court Act in compliance of the judgement of the honourable Supreme Court of India passed in DK Basu versus state of West Bengal.”

The lawyer added, “The accused said there was usage of petrol. According to them, both of them were stripped, beaten and then the OC rubbed cili powder on their wounds before pouring petrol on top. When they were brought to the court, they almost lost their conciousness due. Now, that the case has been registered, hopefully the truth will prevail in investigation.”
