Hailakandi DC prohibits movement of E-Rickshaws on National Highways, imposes restriction for State Highways

On January 5, 2024, the District Magistrate of Hailakandi announced a ban on E-Rickshaws operating on National Highways, with additional restrictions prohibiting their movement on State Highways from 8:00 pm to 8:00 am. The decision was prompted by multiple instances of E-Rickshaw drivers violating traffic guidelines, posing risks to both themselves and fellow commuters.

The order reveals a concerning trend. It was observed that several E-Rickshaws, authorized to operate on rural roads for passenger transport to connect key points on National Highways NH-06 (Dhaleswar to Bhairabi) and NH-37 (Katakhal to Badarpurghat), were found in violation of their permit conditions. These E-Rickshaws were reportedly navigating on National Highways and State Highway SH-39 (Borakhai T.E. Police Check Gate to Rakhal Basti Trijunction), raising concerns about adherence to granted permits.

These National and State Highways are designed for the smooth flow of heavy, small, and medium vehicles without interruptions. However, there have been observations of E-Rickshaws surpassing the permitted speed limits to reach their destinations, posing risks to both themselves and other vehicles.

With the winter season causing foggy roads and reduced visibility, the District Magistrate of Hailakandi, Nisarg Gautam Hivare, IAS, took action. He issued the order prohibiting E-Rickshaws from operating on National Highways, and on State Highways, their movements are restricted from 8 pm to 8 am.

The order additionally requests E-Rickshaws to avoid overloading, ensure that entrance and exit doors are on the left side, and emphasizes that any accidents resulting from violating these directives will lead to legal actions. However, exceptions are made for E-Rickshaws responding to medical emergencies, relaxing the ban on movement under such critical conditions.

The District Magistrate of Hailakandi, implemented this order exercising his powers under Section 144 Cr.P.C. to protect citizens and others from potential harm on roads. These measures are enacted to ensure adherence to safety guidelines and promote a secure environment for everyone on the roads.
